Citation Guidance: The total amount of granting of credit, etc. (meaning granted credit, or contributed funds specified by a Cabinet Order as a contribution; hereinafter the same shall apply in this Article) by a Bank Holding Company or its Subsidiary Companies, etc. (meaning Subsidiary Companies of the Bank Holding Company (excluding those specified by a Cabinet Office Ordinance) and other persons who have a special relationship with the Bank Holding Company specified by a Cabinet Order; hereinafter the same shall apply in this Article) to one person (including other persons who have a special relationship with said person specified by a Cabinet Order; hereinafter the same shall apply in this Article) shall not exceed the amount calculated by multiplying the total net amount of the equity capital of the Bank Holding Company and its Subsidiary Companies by the ratio specified by a Cabinet Order for each category provided therein (hereinafter the amount thus calculated shall be referred to as the "Limit of Granting of Credit, etc. by Bank Holding Company" in this Article); provided, however, that this shall not apply to the cases where the total amount of granting of credit, etc. by a Bank Holding Company and its Subsidiary Companies to one person exceeds the Limit of Granting of Credit, etc. by Bank Holding Company as a result of a Merger, Joint Incorporation-Type Split or absorption-type split involving said person, or of transfer of another person's business to said person, or by other unavoidable reasons specified by a Cabinet Order, and the Prime Minister has given approval for such excess amount of granting of credit, etc. by Bank Holding Company.
